The circular clarifies that the Judicial Authority Law grants judges judicial immunity that prohibits their arrest, investigation, search, or prosecution without permission from the Permission Committee chaired by the President of the Court of Cassation, in accordance with the provisions of the Judicial Authority Law. The circular also states that the Lawyers' Profession Regulation Law guarantees lawyers functional immunity, preventing their inspection, office search, or interrogation without notifying the head of their affiliated branch council, except in cases of evident crime and after informing the branch council. It emphasizes that this immunity is purely procedural and does not exempt judges or lawyers from legal accountability in case of violations or crimes, aiming to provide guarantees protecting them from arbitrary actions, ensuring judicial independence, and positively impacting the rights of litigants. The circular urges public prosecutors and judicial police to strictly adhere to these regulations and not take any action against judges or lawyers without following legal procedures, warning that any violation will entail legal responsibility.
